The California Wv 100 form, officially known as the Petition for Workplace Violence Restraining Orders, serves as a critical tool for employers seeking legal protection for their employees from potential workplace violence. This form is designed for use by employers who have the legal standing to file under California's Code of Civil Procedure section 527.8. It requires the petitioner to provide detailed information about the employee in need of protection, the individual from whom protection is sought, and any additional persons who may also require safeguarding. The form includes sections for documenting the nature of the alleged threats or acts of violence, the relationship between the employee and the respondent, and any previous court cases involving the parties. Additionally, it allows the petitioner to request specific personal conduct orders and stay-away orders aimed at preventing further incidents. The form also emphasizes the importance of completing the Confidential CLETS Information form to ensure that all relevant details are captured. Before filing, it is recommended that petitioners review the accompanying informational guide, which outlines the process for obtaining a restraining order to prohibit workplace violence. This comprehensive approach aims to create a safer work environment by addressing threats proactively and legally.
